Abstract

This study analyzes the factors contributing to group assault committed by children and examines the criminal responsibility of children under the juvenile criminal justice system based on Determination Number 62/Pid.Sus.Anak/2023/PN Tjk. The research employs a juridical-empirical approach, combining an analysis of legal provisions with empirical data obtained through interviews with relevant law enforcement and child protection practitioners. The findings indicate that group assault by children is influenced by several interrelated factors, including peer-group influence, inadequate family supervision, emotional immaturity, low legal awareness, an unfavorable social environment, social and digital media, insufficient character and moral education, previous conflicts, and the lack of positive activities for children. Based on George L. Engel’s Biopsychosocial Theory, these factors interact across biological, psychological, and social dimensions in shaping children’s behavior. In terms of criminal responsibility, children can still be held legally accountable when the elements of the offense are fulfilled. However, the form of accountability must prioritize the child’s best interests, rehabilitation, and social reintegration. In this case, the successful implementation of diversion resulted in a restorative resolution rather than imprisonment. This approach is consistent with the objectives of the Juvenile Criminal Justice System, particularly child protection, restoration of relationships, prevention of recidivism, and the development of responsible behavior.
