ISLAMIC LAW ANALYSIS ON ONLINE BUYING AND SELLING IN THE PERSPECTIVE OF FIQIH MUAMALAH

This study aims to analyze the concept of online buying and selling from the perspective of Islamic Law (Fiqh Muamalah) and its implications in modern economic transactions. The method used is legal research with a normative approach based on Islamic law. This study is descriptive with qualitative analysis techniques on sources of Islamic law, fatwas of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI), and regulations in force in Indonesia. The results of the study indicate that online buying and selling is included in transactions that are valid according to Islamic Law as long as they fulfill the pillars and requirements of the contract, namely the existence of a seller and buyer ('aqidani), object of transaction (ma'qud 'alaih), and the handover process (shighat). Although transactions are carried out virtually without direct face-to-face meetings, the contract mechanism can still be fulfilled through order confirmation, payment, and receipt of goods. In addition, this study found that in the practice of online buying and selling, aspects of transparency and caution are very necessary to avoid potential fraud. In Islamic law, online buying and selling transactions can be categorized as mu'athah buying and selling, which are valid as long as there is an agreement between the seller and the buyer. Thus, the development of technology in the digital era brings significant changes in the practice of muamalah, but can still be aligned with the principles of Islamic Law. Therefore, a deeper understanding of the contract in online buying and selling is very necessary for the community so that the transactions carried out remain in accordance with Islamic law and applicable laws
