ANALYSIS OF THE CRIMINAL LIABILITY OF CELEBRITIES AS PERPETRATORS OF ONLINE GAMBLING PROMOTION THROUGH INSTAGRAM MEDIA(Study of Decision Number 1156/Pid.Sus/PN. Tjk)

The development of social media, especially Instagram, is used not only as a means of communication, but also as a promotional medium, including the promotion of online gambling which is prohibited by law. This study aims to analyze the criminal liability of celebrities as perpetrators of online gambling promotion crimes through Instagram media. This study uses normative juridical approaches and empirical juridical approaches with data obtained through literature studies and interviews with investigators, prosecutors, legal advisors or defendants, and judges. The results of the study show that celebrities who deliberately promote online gambling through Instagram can be held criminally responsible for having met the elements of criminal acts in accordance with the provisions of laws and regulations. The judge's consideration is based on valid evidence, legal facts at trial, and circumstances that aggravate and mitigate the defendant. The judge's decision has reflected legal certainty, justice, and utility. Therefore, strict law enforcement and increased supervision of promotional activities on social media are needed to prevent similar criminal acts.
