ANALYSIS OF CRIMINAL LIABILITY AS A MEMBER OF THE NATIONAL POLICE WHO COMMITTED THE CRIME OF BUYING AND SELLING AMMUNITION (Study of Decision Number 203/Pid.Sus/2023/PN Tjk)

Illegal firearms trafficking is a criminal act that threatens public security and order.The problem becomes more serious if it involves members of the National Police of the Republic of Indonesia as law enforcement officers who are supposed to maintain security and enforce the law.This study aims to analyze the criminal responsibility of members of the National Police who are involved in the crime of buying and selling illegal firearms and analyze the basis of judges' considerations in imposing verdicts against the perpetrators. This study uses normative juridical approaches and empirical juridical approaches. Data were obtained through literature studies of laws and regulations,court decisions,and relevant literature, as well as field research through interviews with Lampung Police investigators, prosecutors at the Bandar Lampung District Attorney's Office,legal advisors or defendants, and judges at the Tanjung Karang District Court Class IA.The results of the study show that members of the National Police who are proven to have bought and selling illegal firearms are still criminally responsible in accordance with the provisions of applicable laws and regulations,in addition to being subject to disciplinary sanctions and the police professional code of ethics.The judge's consideration in imposing a verdict is based on valid evidence, legal facts revealed at the trial, as well as circumstances that aggravate and mitigate the defendant.The decision has reflected the legal goals of legal certainty,justice,and usefulness so that it is expected to be able to provide a deterrent effect,maintain the integrity of the National Police institution,and increase public trust in law enforcement
